TERMS + CONDITIONS

These Terms and Conditions (“Terms”) are a contract between you and National Pickleball League (“NPL” or “we”) and govern your participation in any NPL event, league, program or competition (“Event”) at the facilities, grounds, courts, fields (“Venues”) we operate. Please read these Terms carefully before participating in any NPL Event.

1. TERMS

a) Acceptance of Terms. By participating in any NPL Event, you accept and agree to be bound by these Terms, just as if you had agreed to these Terms in writing. If you do not agree to these Terms, you must not participate in any NPL Event.

b) Amendment of Terms. NPL may amend the Terms from time to time. Unless we provide a delayed effective date, all amendments will be effective upon NPL posting the updated Terms. Your continued participation in any NPL Event after the posting of the amended Terms constitutes your consent to be bound by the Terms as amended.

2. OUR SERVICE

NPL is a service that organises Events at Venues predominantly across Victoria, but throughout Australia. NPL itself does not own, operate or control any Venues that Events are operated from.

3. VENUE WAIVERS AND TERMS

Participants of NPL Events are deemed as members. Your participation in any Event may be subject to additional waivers, policies, rules or conditions of the Venue where NPL Events are conducted. NPL or the applicable Venue may restrict your access if you do not agree to or

comply with such conditions or these Terms. If you have questions about a Venue’s waiver or other terms, please see the applicable Venue’s website or contact the Venue directly.

4. ASSUMPTION OF RISK

Although NPL endeavours to offer Venues and Events that are safe, you understand that there are certain inherent risks and dangers in participation in sport and that the games you may play in will vary in intensity, skill level & weather conditions. By playing in a NPL Event, you

acknowledge and agree, on behalf of yourself, your heirs, personal representatives and/or assigns that you are aware of these risks which include, but are not limited to, property damage, illness and bodily injury or death. You acknowledge that some of these risks cannot be eliminated and you specifically assume the risk of injury or harm. You acknowledge and agree that it is your responsibility to consult with your primary care physician prior to participating and to determine if and how participating in any NPL Event. Therefore, to the fullest extent permitted by law, you release, indemnify, and hold harmless NPL, and each of their respective officers, directors, members, employees, consultants, contract

employees, representatives and agents, and each of their respective successors and assigns, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages and liabilities (including for ordinary negligence and the application of any of the provisions of

Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law) arising out of or in any way related to your participation in NPL Event, including with respect to bodily injury, physical harm, illness, death or property damage.

5. MEDICAL EXPENSES REIMBURSEMENT

NPL does not provide reimbursement of medical expenses for injuries sustained while participating in Events. We encourage you to take out your own Private Health, Life & Income Protection insurance in accordance with your own needs and circumstances.

6. DISCIPLINE

As a condition of participation in NPL Events, you agree to the Code of Conduct that is available at www.nplpickleball.com.au/code-of-conduct.

NPL has the right to take any action deemed necessary in the best interests of all participants and all decisions relating to discipline are final.

7. EVENTS

The Event Owner and Event Organiser’s decisions will be final and no correspondence or disputes entertained. The NPL will make reasonable effort to communicate all event changes to entrants but reserves the right to make any alterations to events, without notice, including format/time/date/location.

8. PHOTOGRAPHY

As a condition of participation, NPL may use still images, moving images, image and likeness recorded of your participation at any time to promote our Event/competitions or any similar Event by any form of media. Each entrant consents to the publication and/or use in any form of media whatsoever including Social media of their name, personal information, results, image and statements in any context pertaining to the event/s or otherwise during or after the event/s whether for advertising, promotions or otherwise for no fee or remuneration.

9. PRIVACY

Your privacy is important to NPL. By registering for any NPL Event, Tournament or League, you consent to your personal information being used for the purposes set out below:

We collect information about you, including for example your name, phone number and contact details which you provide when registering for the Event, as well as information from social media services and other entities you deal or interact with for example by using their services.
We collect and use this information for the purposes of Event administration, promotion, to provide you with targeted advertising based on your online activities, to improve the Event or future events, to notify you of future events which may be of interest to you, and for any other purposes that we describe at the time of collection.

NPL uses high ethical standards and respects your privacy. We will diligently safeguard and protect the privacy and confidentiality of your personal details.

10. COVID

Each entrant agrees that they will not attend the Physical Event if the following apply:

Entrant displays symptoms of coronavirus (COVID-19) such as: cough, fever, sore throat, fatigue or shortness of breath on the day of the Event or at any time in the 14 days prior to the Event;
Entrant is positive for coronavirus (COVID 19);
Entrant has been in contact, or suspects they have been in contact with a person who is diagnosed as coronavirus (COVID 19) positive in the 14 days prior to the event or on the day of the Event;
Entrant has travelled overseas in the previous 14 days;
Entrant is required to be in quarantine or isolation.
